Article 37 of the current Collective Bargaining Agreement requires that the parties
resolve any differences during negotiations by using an agreed upon Arbitrator to issue an award that is binding on both parties.
The Union submitted its final reply submissions to the arbitrator on January 31, 2017. As part of this submission, the Union included a comprehensive third-party Forensic Accountant Report of the Employer's financial disclosure to the Union.
As a consequence of the procedural disputes between the parties, the Employer raised concerns about the admissibility of the Union's third-party assessment of the Employer's financial disclosure. On February 20, 2017, the arbitrator returned a decision that granted the admissibility of the Union's Forensic Accountant Report. In turn, the arbitrator also permitted Counsel for the employer to respond to the items that are strictly found within the Forensic Report. Counsel for the employer has until March 15, 2017 to respond accordingly with their rebuttal.
This, unfortunately, has caused further delays in the arbitrator rendering a timely decision. The arbitrator will be on his annual leave of absence from March 9, 2017 to April 9, 2017 and will attempt to render a decision with thirty (30) days thereafter his return.
